INTRODUCTION

This document, together with the website’s terms of use, sets forth the terms and conditions for booking transfers, trips, and all other services offered (hereinafter, the Terms and Conditions).

Please read these Terms and Conditions carefully before making any transaction. By using this website or placing an order through it, you agree to be bound by these Terms and Conditions; therefore, if you do not agree to all of the Terms and Conditions, you should not use this website.

These Terms and Conditions are subject to change. It is your responsibility to review them periodically, as the terms and conditions in effect at the time you use the website or place a reservation order will be the ones that apply to you.

HOW TO REGISTER

You do not need to register to access our services; you can make travel reservations as a guest (without registering). Users may register by filling out the registration form, which will ask for personal information that must be up-to-date and accurate. At the end of the registration process, users must accept these GENERAL RESERVATION TERMS AND CONDITIONS and our PRIVACY POLICY.

The user ID and registration password, if required, must be kept in a safe place. Once the user has obtained their user ID and password, they will be able to access the “My Account” section, where they can modify their registration information and view and track the status of their reservations.

Use of This Website

By using this website and/or placing orders through it, you agree to:

1. Use the services solely to make legally valid inquiries or reservations.
2. Do not engage in any false or fraudulent transactions. If it can reasonably be considered that such a transaction has taken place, we are authorized to cancel it and report it to the relevant authorities.
3. Provide us with your email address, mailing address, payment information, and/or other contact information truthfully and accurately. You also consent to our use of this information to contact you if necessary. See our PRIVACY POLICY.

If you do not provide us with all the information we need, we will not be able to process the selected transactions.

By submitting an inquiry or request for services through this website, you represent that you are at least 18 years of age and have the legal capacity to enter into contracts.

GEOGRAPHICAL SCOPE

The services offered through our website are available only to individuals legally residing in Spain.

RESERVATIONS THROUGH OUR WEBSITE

To make any travel reservations through the services offered on this website, you must select a valid payment method and authorize us to charge you using that selected payment method.

Any transaction is subject to the User reading and accepting these General Booking Terms and Conditions. Once these terms and conditions, as well as the terms and conditions applicable to the booking and purchase of the selected product, have been accepted and the corresponding payment has been made, we will complete the transaction as soon as possible.

If, due to certain circumstances, we are unable to fulfill the orders placed, we will notify you as soon as possible.

PRICES AND PAYMENT METHODS

All prices listed on our website are in EUROS (EUR). The purchase and sale of virtual currencies are not subject to VAT; however, you are solely responsible for any tax obligations that may arise from the transactions you place.

Payments and refunds for all transactions will be made in euros (EUR). If your credit or debit card is not denominated in euros, the exchange rate will be applied by your bank based on the market exchange rate and may differ from the price listed on our website.

Any change in the price of the aforementioned items may result in an adjustment to the final price of the trip, either upward or downward, in an amount strictly corresponding to the price changes in question. The traveler will be notified of these changes in writing. Price adjustments in accordance with the provisions of Article 158 of Royal Legislative Decree 1/2007, dated November 16, which approves the Consolidated Text of the General Law on the Protection of Consumers and Users and other complementary laws, will only take place if the travel organizer has expressly reserved that right and has communicated this in the pre-contractual information provided to the traveler prior to the conclusion of the contract.

PAYMENT METHODS

The payment methods available on our website will be displayed during the booking completion process.

Astur Transfer will always use secure payment methods, and payments are processed through Redesys. Astur Transfer will not store any information regarding the card details used in its records. By using a debit or credit card, the user confirms that the card used belongs to them or that they have been duly authorized by the cardholder to use it. Credit and debit card transactions are subject to security checks and validation by the card issuer. In the event that the card issuer declines the transaction, Astur Transfer will not be liable for any delays or cancellations of the transactions. When funds are deposited via credit or debit card, any fees or charges that the payment service provider may have charged the website owner will be the sole responsibility of the customer.

RIGHT OF WITHDRAWAL

Transactions made on our website include: trips, activities, and tourist services booked directly with various providers and tour operators. All of these are subject to the right of withdrawal in accordance with the terms and conditions for refunds established by the service provider for each product in the package tour contract or in the purchase of individual services, as applicable, and of which you will be made aware before accepting payment.

RIGHT OF WITHDRAWAL

Transactions made on our website include: Transfers, shuttle services, and tourist shuttle trips that are booked directly with various providers and tour operators or directly with us. All of these are subject to the right of withdrawal in accordance with the terms and conditions of refund established by the service provider for each product in the travel contract or in the purchase of individual services, as applicable, and of which you will be made aware before accepting payment.

Withdrawal Period:

- The customer may request cancellation of their reservation and a refund of the amount paid within 24 hours of making the reservation.

Procedure for Canceling a Reservation:

- To cancel a reservation, the customer must contact our customer service department via the contact form or by using the WhatsApp button located at the bottom right of each page on this website, providing the reservation/order number and contact information.
- The cancellation request must be submitted within the 24-hour period mentioned above.

Refund of the Amount Paid:

- If the cancellation request is made within 24 hours, we will refund the full amount paid by the customer.
- The refund will be issued via the same payment method used for the reservation within 7 business days of the cancellation being accepted.

Non-Refundable After 24 Hours:

- Once 24 hours have passed since the reservation was made, cancellation requests will not be accepted, and no refunds will be issued for the amount paid, regardless of the reason for the cancellation.

Changes to the Reservation:

- Requests to modify a reservation must also be made within 24 hours of making the reservation.
- Changes are subject to availability and may incur additional charges.

Force Majeure:

- In cases of force majeure (e.g., natural disasters, public health emergencies, etc.), Astur Transfer will evaluate each case on an individual basis and reserves the right to apply different cancellation and refund policies.

OUR RIGHT TO MODIFY THESE TERMS

Astur Transfer may review and modify these Terms at any time.

You will be subject to the policies and Terms and Conditions in effect at the time you use this website or perform each transaction, unless we are required by law or by a decision of a government agency to make retroactive changes to those policies, Terms and Conditions, or PRIVACY POLICY, in which case any such changes will also apply to orders you have placed previously.

PROTECTION OF PERSONAL DATA

In accordance with the provisions of the General Data Protection Regulation and other applicable regulations on the matter, we hereby inform you that the personal data you provide to us through our website or via email will be processed by the owner of this website, acting as the data controller, in order to carry out the requested transactions and to send you periodic notifications via electronic means. The legal basis for the processing is the provision of the requested services. You can find more information about the processing of your data and the purposes described in the PRIVACY POLICY, which must be read, understood, and accepted in order to use the services on this website.

Owner

The owner of this website is committed to maintaining the confidentiality of personal data and has therefore taken the necessary measures to prevent its alteration, loss, or unauthorized processing or access, taking into account the current state of technology at all times.

Users

In any case, all users have the right to exercise, at any time, their rights of access, rectification, restriction of processing, erasure, objection, and data portability by sending a written request to Astur Transfer via the contact form on this website, providing proof of their identity. If you deem it necessary, you may file a complaint with the Spanish Data Protection Agency.

DISCLAIMER

We will not be liable for any failure or delay in fulfilling any of the obligations we have assumed when such failure or delay is due to events beyond our reasonable control (“Force Majeure”). Force Majeure shall include any act, event, failure to act, omission, or accident beyond our reasonable control, including, but not limited to, the following:

(i) Strikes, lockouts, or other industrial action.

(ii) Civil unrest, revolt, invasion, terrorist threat or attack, war (whether declared or not), or threat or preparations for war.

(iii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.

(iv) Inability to use trains, ships, airplanes, motor vehicles, or other means of transportation, whether public or private.

(v) Inability to use public or private telecommunications systems.

(vi) Acts, decrees, laws, regulations, or restrictions issued by any government or public authority.

It is understood that the obligations will be suspended for as long as the Force Majeure Event continues, and we will be granted an extension of the deadline for fulfilling such obligations for a period equal to the duration of the Force Majeure Event. We will use all reasonable means to bring the Force Majeure Event to an end or to find a solution that allows us to fulfill our obligations despite the Force Majeure Event.

INTEGRITY

These Terms and Conditions and any document expressly referred to herein constitute the entire agreement between you and us regarding the subject matter hereof and supersede any prior agreement, understanding, or promise between you and us, whether oral or written.

Both you and we acknowledge that we have agreed to enter into this contract without relying on any statement or promise made by the other party or that could be inferred from any statement or writing during the negotiations between us prior to the contract, except as expressly set forth in these Terms and Conditions.

Neither you nor we shall have any remedy with respect to any uncertain statement made by the other party, whether oral or written, prior to the date of a contract (unless such uncertain statement was made fraudulently), and the only remedy available to the other party shall be for breach of contract in accordance with the provisions of these Terms and Conditions.

If any of these Terms and Conditions or any provision of a contract is declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in effect and shall not be affected by such declaration of nullity.

JURISDICTION AND APPLICABLE LAW

The sale is deemed to have taken place in Spain; therefore, for any questions of interpretation or disputes that may arise, Spanish law shall apply, and in the event of a dispute, both parties agree to submit—waiving any other jurisdiction that may apply—to the jurisdiction of the courts and tribunals of the Consumer’s place of residence.
